President Obama nominates Elena Kagan to the Supreme Court……

As the Dog expected*……

President Obama has nominated his Solicitor General Elena Kagan to fill the upcoming vacancy  in the United States Supreme Court when Justice Stevens retires as at the end  of this spring term.

This will be Obama’s second  nomination to the court, and the second woman he has chosen……

Kagan who has been a judge , has also been  a former Dean of Havard Law School……

And has had Republican votes counted ( 61 -31 )  in her confirmation to be confirmed to the Solicitor General job……

The ironic part of this who thing is in her job as Solicitor General she has argued before the court representing the Government…..

If confirmed ….She would move TO the court……

She is Single, Jewish and 50 years old…..

Now the we get to see the political dance in the Senate…and the Media……

Kagan, 50, the former dean of Harvard Law School, would become the fourth woman to serve on the high court; if she is confirmed, the nine-member court would have three female justices for the first time.

In nominating Kagan to replace retiring Justice John Paul Stevens, Obama is breaking with tradition. Every other member of the court is a former federal appeals court judge, and Kagan has never served in the judiciary. The last time a non-judge was appointed was in 1972, when President Richard M. Nixon nominated William H. Rehnquist and Lewis Powell in the same year.

In announcing his choice of Kagan, Obama strongly praised the departing Stevens, saying he had “emerged as a consistent voice of reason” on the high court, helping his colleagues find common ground on contentious issues.

“While we can’t presume to replace Justice Stevens’s wisdom or experience, I have selected a nominee who I believe embodies that same excellence, independence, integrity and passion for the law and who can ultimately provide that same kind of leadership on the court,” Obama said.

Kagan took the podium after Obama spoke, thanking him. Saying her respect for the court has become “ever deeper and richer” in her time before the court as solicitor general, Kagan said it was a tremendous honor to replace Stevens. “The court is an extraordinary institution,” she said.

Kagan, whom Obama considered nominating during the last Supreme Court vacancy, is the government’s top appellate lawyer and representative at the Supreme Court. She was confirmed as solicitor general last year by the Senate in a 61-to-31 vote and was the first woman confirmed to hold the job.

Because she would replace Stevens, the leader of the court’s liberal bloc, the ideological balance among the nine justices would not change.

    Did someone unknown just win the Peace Prize again?

    Without doing anything except being themself?

    Order in the Court and pardon my Robert “Mr. Qualified” Bork, but suffer-in succotash!

    Looks like some more Hasty Pudding to me.

    And do not be fooled by that crafty Obama.

    Kagan is not a replacement for Stevens.

    She is a replacement for Ginsberg.

    Nov 2010 could leave Obama without a majority in the Senate.

    So Kagan will sit there like a vulture in a old western movie.

    Smell the coffee yet Ruth?

    And Larry Summers,

    who once said that innate differences between men and women might be one reason fewer women succeed in science and math careers,

    is the one who made her the Dean of Harvard Law.

    Where she tried to keep military recruiters off campus.

    Even though she now guilty of soliciting Generals.

    Don’t ask, don’t tell?

    Or just say NO!

    I predict Kagan will end up being to the Supreme Court what the Banking Modernization Act was to the economy.

    Now that I have had my coffee I predict she gets nominated faster than you can say Goldman Sacs. And I cannot wait to see Al Franken cross examine her. Now we will find out what case Perry Mason lost!

  3. Manila, Kagan will get confirmed very easily by a margin of 69-31 at best because GOP Senators will try to filibuster just to embarrass the Prez, but it won’t work.

    Ginsburg is NEXT on the retirement watch.

    Nah! It has nothing to do with embarrassment unless she had an affair with Keith “Giggles” Olberman. You always try to get some mileage out of these hearings somehow.

    She will be confirmed after much hand wringing.

  7. Finally, it will be nearly impossible to criticize Obama’s pick because it is rumored she is a lesbian. If you point out her Wall Street connections, you will be called homophobic the same way any criticism of Obama is deemed racist and dismissed as the hateful ravings of white supremacists.

The “tradition” of nominating appeals court judges is relatively new; what’s novel and appalling is that with Souter’s and O’Connor’s retirements, no current Justice has trial court experience as a judge, prosecutor or public defender with witnesses and direct testimony. So Justices rule on evidence and criminal procedure in a rather abstracted, theoretical, impractical way.

    • I meant to say that the “tradition” of appointing only federal appeals court judges is relatively new. Presidents and Senators are more comfortable with candidates who have already received at least one confirmation, and who have an easily-searchable body of rulings.

  10. Is she mystery meat?

    Does she have an agenda?

    I think she wants to make the history books somehow and at 50 she could end up as Chief Justice.

    The upcoming election does make her selection an issue especially as she has worked with Goldman Sachs and is from Harvard. Saying her name in the same breath as Larry Summers gives me pause. Anyhow there is always something in anyones background to mix with water and make mud (or tea for that matter) out of it.

    I think we see a shallow repeat of the Sotomayor circus with about the same result but any indiscretion (hard to find as she has been locked up in classrooms or boardrooms all her life) could mean disaster.
