Judge Rejects Gov. Jan Brewer’s Challenge to Arizona’s Immigration Law……

The  lawsuit against the new Arizona Immigration law moves on…..

After the state tried to stop it…

A lawsuit challenging the constitutionality of Arizona’s controversial immigration law is going forward after a federal judge threw out a challenge by Gov. Jan Brewer and others.

U.S. District Judge Susan Bolton has ruled that motions to dismiss filed by Brewer, Maricopa County Sheriff Joe Arpaio and Pinal County Sheriff Paul Babeu were insufficient, The Arizona Republicreported Tuesday.

The suit was brought by the American Civil Liberties Union, the immigration advocacy group Friendly House, and other organizations. The judge found merit in their claims that portions of the law may violate the 4th Amendment, which forbids unreasonable search and seizure, and the 14th Amendment, which prohibits racial discrimination and unequal treatment for different classes of people.

Bolton decided the plaintiff’s request for an injunction was moot since a stay has been in effect since July when a separate lawsuit was brought by the Justice Department, the Republic reported. There will be a hearing on that stay Nov. 1 before San Francisco’s Ninth Circuit Court of Appeals…..
