The White House and Senate are close to deal on the Gitmo detainees….doing military trials not civilian ones…..

The deal is being done by the White House….. just as the Dog predicted it would be…..

AG Eric Holder will be told the results……

The Dog mentioned in a past before that Obama won’t make the rookie mistake of letting a cabinet member make a policy decision that will put him a jam anymore….this isn’t unexpected …..all president’s go thru this transformation…learning that in the confrontational world of national politics you cannot afford to let people make decisions just on their merits (imagine that! ) …..politics rears its head in everything…..

The White House is nearing a deal with a bipartisan group of senators to close the Guantanamo Bay prison and pave the way for more detainees to be tried before military commissions, a move that would reverse a signature Obama administration security policy.

The deal would put the alleged mastermind of the attacks of September 2001, Khalid Sheikh Mohammed, his fellow plotters and other top terror suspects before revamped military commissions, rather than in civilian trials as the Obama administration had sought. These courts would offer defendants more rights than they had under the Bush administration, but fewer than they would be afforded in civilian court.

The effort, led by White House counsel Robert Bauer and White House Chief of Staff Rahm Emanuel, further sidelines Attorney General Eric Holder, who at a hearing Tuesday continued to argue that the planners of the Sept. 11, 2001, attacks and other terrorists should be given civilian federal trials.

Any such deal would represent the final repudiation of Mr. Holder’s November decision to bring the 9/11 plotters to civilian trial in New York City, and a switch for the White House, which suspended the Bush-era military commissions as one of its first acts in office. The White House and the Justice Department appear to be at loggerheads on the matter, and Justice Department officials say they are not a party to the negotiations.

The framework of the deal is being led in Congress by Republican Sen. Lindsey Graham of South Carolina. Mr. Graham wants civilian courts to be reserved for low-level Al Qaeda operatives and terrorist financiers, a far smaller group than previously considered.

Eric Holder The Attorney General learns that even the nation’s Top Cop has to play Politics…..

In a humanizing and process piece in today’s New York Times the White House goes about the trying to taking the heat off the decision by Holder and the President to try the Gitmo 5 in the downtown New York City Federal Court House……

The Dog is sure that they both feel a little like they got set-up on this one……The piece intimates that the decision was Attorney general Holder’s to make…..which he did after talking in house and with officials in New York City…..Holder who is from Queens, New York must assuredly thought that the New York City Police Department , the largest U.S. Police Department  (over 30,000 strong ) could certainly handle the security of trial being handled in the city…..and when notified of his decision did in fact step up to the plate……

But the problem was not in the details and logistics…it came after a while in the political sense…..

Mayor Bloomberg , who was happy with the plan,  prestige and money…...began to hear whispers from concerned business people in downtown New York City about the effect of all those closures and lockdowns that would come with the trial…..Those whispers began to become loud and vocal when those people realized that a trial could take up to a year……and as the fact of the trial sank in people, even those not in the city….began to get scared……

The trial itself was always a political decision…Obama promised it as a delineation from his administration from George Bush’s (that divination is almost completely gone in respect to Iraq and Afghanistan)

And so New York City Mayor Mike Bloomberg did a 180 in public a little while ago and turned the issue on its head and gave the Republican’s yet another weapon to throw at the Obama administration…..

To be fair…..Eric Holder is a Cabinet Secretary…he gets a bit of a pass because of the Gonzalez US Attorney hiring scandal…..but all major decisions initiated by the Administration have political sides and Holder has found this out the hard way….so far the say says he’s resiresisitedsited get ting a White House political person in stalled (I think of the old Russian policy from Tom Clancy’s The Hunt for Red October ) but the  fact is….in a little while there most certainly will be one in place……the White House simply cannot afford having Holder make a political mistake before Obama reelection start-up…..even if Holder has the law on his side…..He still serves at the pleasure of the President and the President surely wants another term…..

Last winter, when Attorney General Eric H. Holder Jr. called the United States a “nation of cowards” for avoiding frank conversations on race, President Obama mildly rebuked him in public.

Out of view, Mr. Obama’s aides did far more. Rahm Emanuel and Jim Messina, the White House chief and deputy chief of staff, proposed installing a minder alongside Mr. Holder to prevent further gaffes — someone with better “political antennae,” as one administration official put it.

When he heard of the proposal at a White House meeting, Mr. Holder fumed; soon after, he confronted his deputy, David W. Ogden, who knew of the plan but had not alerted his boss, according to several officials. Mr. Holder fought off the proposal, signaling that his job was about the law, not political messaging.

A year later, he is no longer so certain. His most important plan — to try Khalid Shaikh Mohammed, the self-described architect of the Sept. 11 attacks, in federal court in Manhattan — collapsed before it even began, after support from the public and local officials withered.

Now Mr. Holder has switched from resisting what he had considered encroachment by White House political officials to seeking their guidance. Two weeks ago, he met with advisers there to discuss how to unite against common foes. They agreed to allow Mr. Holder, who has not appeared on a Sunday talk show since entering office, to speak out more; he agreed to let them help hone his message.

The political attacks over terrorism cases were “starting to constrain my ability to function as attorney general,” he said in an interview last week. “I have to do a better job in explaining the decisions that I have made,” Mr. Holder also said, adding, “I have to be more forceful in advocating for why I believe these are trials that should be held on the civilian side.”

But now Mr. Holder is in the awkward position of pushing for an approach that he acknowledges he would accept defeat on. The administration hopes to announce a new venue for the Sept. 11 trial within three weeks, he said last Tuesday. But Congress could pass legislation requiring that Mr. Mohammed be tried by a military commission, or Mr. Obama himself could change direction.

“You always have to be flexible,” Mr. Holder said, allowing that justice could be served in a commission trial, too, and praising generals who “adapt their game plans” as the situation changes.

Attorney General Eric Holder comes home to New York to check on Gitmo Trial operation….

Eric H. Holder Jr, the nations Attorney General. Traveled to New York City Wednesday to confer with most of the security bosses that will handle the upcoming trial of the 5 Gitmo terrorists…and to see the site for himself.

He visited the Metropolitan Correctional Center (Federal jail)…

He visited the United States Attorney’s Office  at 26 Federal Plaza ( the lawyers that will try the case)….

He visited the United States Federal Courthouse (the location of the trial)….

These three locations are no more that a mile from the World Trade Center, where a new One Trade Center  is rising from the pit……

Holder also held meetings with Local FBI director, Joe Demarest, U.S. Marshal’s boss Joseph Guccione, and Bureau of Federal Prisons personnel……

New York City Police Department Commissioner Ray Kelly also spoke to the Attorney General, since the NYPD will responsible for the security movements of the suspects, and the general security of the entire area, along other local Law enforcement agencies……( Kelly is working on getting the city back the estimated $75 million it will cost to host the trial, which could last into the summer)

Holder is a native New Yorker, who grew up East Elmhurst, Queens, New York…..Across the East River from Manhattan….

‘Heads I Win, Tails You Lose’: In 9/11 Case, KSM Won’t Walk Free Even If Found Not Guilty

Attorney General Eric Holder acknowledged on Wednesday a previously unspoken proviso to the controversial decision to try alleged 9/11 mastermind Khalid Sheikh Mohammed and four co-conspirators in a federal court in New York: even if the defendants are somehow acquitted, they will still stay behind bars.

Holder’s comments at a hearing before the Senate Judiciary Committee would seem to turn the criminal-justice system on its head. The whole point of a criminal trial is to determine guilt—and if the government fails to make its case beyond a reasonable doubt, the defendant walks free.

At least that’s the way the system usually works.

Note: This whole thing is getting worst everyday….next they will be telling the judge and the jury what to say…..

THIS IS AMERICA….RIGHT?

On AG Eric Holder and holding the trials in New York City….

As I watched the nation’s top lawyer, Attorney General Eric Holder, explain that he would be putting five detainee’s from Guantanamo Bay, in Cuba on trial in a United States Federal Court in downtown New York City around the corner from the World Trade Center  I thought of several things…First …the New York City Police Department has 35,00 cops….along with the US Marshals..there won’t be any problem with security for the trial…..the symbolism was not hard to get….I smiled…but I caught the same thing everyone else in the room caught when someone asked Holder…..”What happens if they are not found guilty?”….I thought…”uh oh?!”…..

While the most pressing political thing is the move is to take care of a campaign problem…..Holder and his boss , The President may have created a bigger problem……..

If my memory serves me well….nNota lot of bad guys tried for terrorism by the FBI have been found guilty of the original charges…as a matter of fact most of them have ended up pleading down to lessor charges…a few even have had the government end up paying them money after they sued and only got them to promise not to come to the United States…..

My mind started to race…..Holder, after assuring everyone that he was sure that these people were guilty, began to slowly realize that he was a member of every court in the United States as AG, he then began to back away from the impression that he  was 1) Shopping for favorable judges, and 2) He was prejudging the verdict of the case in such a way that could prejudice any trail in America….

Now the Republicans aren’t stupid…and they have gone on overdrive to ask the question that reporter never got answered at the presser……’What happens if they are not found guilty?”

Sure the government could recharge them with other crimes…but the government loses cases….government lawyers sometimes get yanked off cases by judges…..and juries are the  arbitrators of  court cases….and you know we could have a situation where Holder is standing in front of a judge getting admonished that the defenders in a trial could have been found not guilty  by a jury and the judge expected them to go free……I can’t see that happening…but it could……

Note: After the move there will be about 215 more detainees at the Guantanamo Bay facility……
