Gitmo Detainee Update…..

How’s the Obama Administration doing on the Guantanamo Detainee’s………

Here’s a run down…….

One thing we know……

There will NO trials in New York  City….

and Eric Holder doesn’t have the final say……the White House now does……

The issue is a lose..lose one for the President…..

A senior administration official would only say that discussions with Congress — that is, Democrats and Sen. Lindsey Graham — are “ongoing” about a legal framework. But frustration at the lack of public backstop from the White House is pervasive among senior officials at the Departments of Justice, State and Defense, all of whom want the Guantanamo Bay detention camp closed and the prisoners properly dealt with. There’s also a sense that the chance to build a political consensus around a sustainable, humane and transparent detention policy is gone — and that the longer we don’t hear from the president, the easier it is for Republicans to demagogue the issue. Here’s an update on the raw numbers:

The administration’s special envoy to Guantanamo, Amb. Daniel Fried, has successfully repatriated 31 detainees. 3 have been sent to third countries. 2 have been sent to Italy for prosecution.
Not including the Yemeni detainees, there are 41 cleared detainees who are eligible for either repatriation or resettlement in a third country.
There are about 35 detainees who are deemed to be triable, either using the military tribunals that the Obama administration endorsed (hastily, they will admit, in retrospect) or in federal courts. Congress and the executive branch haven’t agreed on how this will work, and the courts are getting frustrated.

The White House and Senate are close to deal on the Gitmo detainees….doing military trials not civilian ones…..

The deal is being done by the White House….. just as the Dog predicted it would be…..

AG Eric Holder will be told the results……

The Dog mentioned in a past before that Obama won’t make the rookie mistake of letting a cabinet member make a policy decision that will put him a jam anymore….this isn’t unexpected …..all president’s go thru this transformation…learning that in the confrontational world of national politics you cannot afford to let people make decisions just on their merits (imagine that! ) …..politics rears its head in everything…..

Here’s some of the piece from the Wall Street Journal…….

The White House is nearing a deal with a bipartisan group of senators to close the Guantanamo Bay prison and pave the way for more detainees to be tried before military commissions, a move that would reverse a signature Obama administration security policy.

The deal would put the alleged mastermind of the attacks of September 2001, Khalid Sheikh Mohammed, his fellow plotters and other top terror suspects before revamped military commissions, rather than in civilian trials as the Obama administration had sought. These courts would offer defendants more rights than they had under the Bush administration, but fewer than they would be afforded in civilian court.

The effort, led by White House counsel Robert Bauer and White House Chief of Staff Rahm Emanuel, further sidelines Attorney General Eric Holder, who at a hearing Tuesday continued to argue that the planners of the Sept. 11, 2001, attacks and other terrorists should be given civilian federal trials.

Any such deal would represent the final repudiation of Mr. Holder’s November decision to bring the 9/11 plotters to civilian trial in New York City, and a switch for the White House, which suspended the Bush-era military commissions as one of its first acts in office. The White House and the Justice Department appear to be at loggerheads on the matter, and Justice Department officials say they are not a party to the negotiations.

The framework of the deal is being led in Congress by Republican Sen. Lindsey Graham of South Carolina. Mr. Graham wants civilian courts to be reserved for low-level Al Qaeda operatives and terrorist financiers, a far smaller group than previously considered.

The United States Justice Department will decide very shortly about bring more Gitmo detainees to Brooklyn to be tried...President Obama has reiterated his wishes to detention center on the tip of Cuba closed and things are accelerating…..New York City…Attorney general Eric holder’s home town is playing the leading role in the moves…..
