The White House looks to reverse Attorney General Holder on the Terror Trials…….

Finally getting the message that although Presdient Obama made acampaign promise to try the Girmo 5 and others in civilan courts…the fact is Oabam is the president now…and that policy really doesn’t make too much sense is just needlessly pissing people off and giving the Republicans ammo to shot at them…..

While nice in theory …the practical thing is NOT parade these people in showroom trials that will become political not legal theatre…..

My suggestion…swallow hard…and come out and tell the world you’re keeping Gitmo open……

If you want to bring some of the lesser bad guys to the Michigan prison…do that…but there is absolutly no reaason to carry on with trial is Fedearl Corts in New Yrok City or elsewhere in the United States..leave the bad guys on Castro’s Cubian island……

The president’s advisers feel increasingly hemmed in bybipartisan opposition to a federal trial in New York and demands, mainly from Republicans, that Mohammed and his accused co-conspirators remain under military jurisdiction, officials said. While Obama has favored trying some terrorism suspects in civilian courts as a symbol of U.S. commitment to the rule of law, critics have said military tribunals are the appropriate venue for those accused of attacking the United States.

If Obama accepts the likely recommendation of his advisers, the White House may be able to secure from Congress the funding and legal authority it needs to close the U.S. military prison at Guantanamo Bay, Cuba, and replace it with a facility within the United States. The administration has failed to meet a self-imposed one-year deadline to close Guantanamo.

The administration officials, who spoke on the condition of anonymity to discuss internal deliberations, said the president’s legal advisers are finalizing their review of the cases of Mohammed and four alleged co-conspirators. Asked about the process, White House press secretaryRobert Gibbs said that “no decisions have been made.”

Privately, administration officials are bracing for the ire of disappointed liberals and even some government lawyers should the administration back away from promises to use civilian courts to adjudicate the cases of some of the 188 detainees who remain at Guantanamo.

‘A sad day’

Marine Col. Jeffrey Colwell, acting chief defense counsel at the Defense Department’s Office of Military Commissions, said it would be a “sad day for the rule of law” if Obama decides not to proceed with a federal trial. “I thought the decision where to put people on trial — whether federal court or military commissions — was based on what was right, not what is politically advantageous,” Colwell said.

Is Civil Rights Enforcement back?……..Good, but lets face it…..it’s gonna cost him…….

The New York Times reports that the Obama Justice Department, under the Eric Holder is ‘recharging’ the Civil rights division announcement. They are adding $22 million to the group and hiring more staff. While the second half of the piece seeks to water down the basic announcement the fact is clear. With the election of a black (actually mixed) president Civil Rights is back.  Me, I’m glad…….With the Bush administration the Civil Right division was probably last in line, after the dogs…..

Of course, this is a political blog……..so here’s the other shoe……While this will make the Liberal, progressive and minorities happy…….this is gonna cost anguish for the ‘Blue Dogs’……..Listen Obama had decent coattails in his win last November……the Blue Dogs (and Republicans, of course)  are already gonna leave him because of the ‘public option’….now, bringing the Civil Rights issue into the light is going to bring back the old order of things, and cost several new House members their seats…….they will be unable to hold the line against Republicans fighting ‘change’, public financing of healthcare, the economy spending, and lastly, the old boogie man Civil Rights……..

But I give Obama his props for forging on….but, some of the troops are gonna take a hit in 2010……. no doubt………

Holder and the CIA…When something isn’t what it seems……..

First let me say up front…this is my take…….

Ok…… I’ve sat on this story for about 20 hours, to let it season…and I believe the story is cover fire…..Attorney General Holder has named John Durham to be Justice’s special investigator on 12 cases….given to Justice by the CIA …with prisoner abuse problems…..That got everyone’s attention, right?…….but there are few caveats that go along with the story…….

First of all …these cases were initially given to the BUSH DOJ and dropped…Second……Bill Burton the WH press guy filling in for Gibbs’s mentioned yesterday this quote……..” He (Obama )  agrees with the attorney general that anyone who conducted actions that had been sanctioned should not be prosecuted”……third……Obama clearly has put distance between the story by saying that this is ALL Holder and the CIC doesn’t want to intervene…….

Now if anyone doesn’t think Emmanuel and his staff haven’t gamed this out they’re crazy…….the first thing any political junkie or press person would think is that is political problems for Obama…..but stop and think……Obama has limited this really to do the people who gave the okay to the grunts……any grunt that did something not covering their behind is expendable….and I’ll bet the spot light is gonna end up very bright on one person…..John Yo…..the guy who said the whole thing was Okay in the first place……….

So in the end this isn’t a broad fishing expedition at all……in the end Obama has separated himself from the investigation…and dropped it back in Bush’s lap……and will not bother the guys who did their job under the approval of the nation’s senior law organization.

Update:……While I stand by my analysis of this situation from Obama’s point of view…the inquiry is not sitting well with intelligence community…..seven former CIA chiefs have written to Obama asking that the Justice Department cease and desist in the Holder action on post 9/11 interrogations……..Obama and Justice have reinforced the fact they are not going after the grunts…….but the ex-chiefs are fearful that ‘sources and methods’ maybe compromised in the inquiry. and that the inquiry will have ‘chilling’ effect on the agencies staff…………I expect that in the end it will be Wu, or the whole thing will go away……
