Crude Car bomb fails to go off in Times Square, NYC……

Police and Bomb Squad investigate this dark colored SUV at the corner of 45th and 7th Avenue in Times Square on Saturday night closing at least 4 to 5 blocks.

The New York City Police Department and the FBI are the lead agencies investigating a crude car bomb that failed to go off in a SUV parked in New York City’s Times Square area last  evening…..

The vehicle was loaded with propane and gasoline ……and had firecrackers as a fuse…..

The firecrackers where lit..but burned the car’s interior instead of setting off the liquids in cans….that would have resulted in an explosion….

As with the attempt on the NW 235 flight….the ingination system on the device failed to set the device off…

The vehicle was first noticed by a sidewalk vendor who alerted a nearby police officer….

Once he saw the vehicle….

He called for help…..

The New York City Police Department and Fire Department arrived on the scene and after seeing what they had….

Immediately evacuated several blocks around the area…..

“We are very lucky,” Mayor Michael R. Bloomberg said at a 2:15 a.m. press conference. “We avoided what could have been a very deadly event.”

A large swath of Midtown — from 43rd Street to 48th Street, and from Sixth to Eighth Avenues — was closed for much of the evening after the Pathfinder was discovered just off Broadway on 45th Street. Several theaters and stores, as well as a portion of the Marriott Marquis Hotel, were evacuated. The streets and hotels have since reopened.

Federal authorities said the incident appeared to be an isolated one, and that there was no evidence of an ongoing threat to the city.

“We are treating it as if it could be a potential terrorist attack,”Janet Napolitano, the Homeland Security secretary, told CNN, one of several television appearances she made on Sunday morning.

The bomb itself was not a sophisticated device, Ms. Napolitano said on ABC’s “This Week.” She said there was no clear sense about how large the explosion might have been. “Right now, we have no evidence other than it is a one-off,” she said.

On Sunday, police and F.B.I. officials were also investigating a 911 call placed at around 4 .a.m. on Sunday, several officials said. The caller, who one official said sounded intelligent, admonished the 911 dispatcher not to interrupt him until he was finished and then said there would be a massive explosion soon and the car in Times Square was only a diversion.

The call came from a payphone at West 53rd Street and Seventh Avenue, which detectives have since dusted for fingerprints, the officials said…..

Kevin B. Barry, a former supervisor in the New York Police Department bomb squad, said that if the device had functioned, “it would be more of an incendiary event” than an explosion.

Note...This the first car bomb attemp in New York City since the 1993 first World Trade Center bombing.…..

On AG Eric Holder and holding the trials in New York City….

As I watched the nation’s top lawyer, Attorney General Eric Holder, explain that he would be putting five detainee’s from Guantanamo Bay, in Cuba on trial in a United States Federal Court in downtown New York City around the corner from the World Trade Center  I thought of several things…First …the New York City Police Department has 35,00 cops….along with the US Marshals..there won’t be any problem with security for the trial…..the symbolism was not hard to get….I smiled…but I caught the same thing everyone else in the room caught when someone asked Holder…..”What happens if they are not found guilty?”….I thought…”uh oh?!”…..

While the most pressing political thing is the move is to take care of a campaign problem…..Holder and his boss , The President may have created a bigger problem……..

If my memory serves me well….nNota lot of bad guys tried for terrorism by the FBI have been found guilty of the original charges…as a matter of fact most of them have ended up pleading down to lessor charges…a few even have had the government end up paying them money after they sued and only got them to promise not to come to the United States…..

My mind started to race…..Holder, after assuring everyone that he was sure that these people were guilty, began to slowly realize that he was a member of every court in the United States as AG, he then began to back away from the impression that he  was 1) Shopping for favorable judges, and 2) He was prejudging the verdict of the case in such a way that could prejudice any trail in America….

Now the Republicans aren’t stupid…and they have gone on overdrive to ask the question that reporter never got answered at the presser……’What happens if they are not found guilty?”

Sure the government could recharge them with other crimes…but the government loses cases….government lawyers sometimes get yanked off cases by judges…..and juries are the  arbitrators of  court cases….and you know we could have a situation where Holder is standing in front of a judge getting admonished that the defenders in a trial could have been found not guilty  by a jury and the judge expected them to go free……I can’t see that happening…but it could……

Note: After the move there will be about 215 more detainees at the Guantanamo Bay facility……
